2. User-Submitted Content for Custom Orders Beunikart specializes in transforming your personal photos into custom artwork. When you upload a photo or image to our site for a custom order:

  • You retain ownership: You retain all inherent rights to the original image you upload. By uploading it, you grant us a temporary, non-exclusive license to use, modify, adapt, and print the image solely for the purpose of fulfilling your custom order.

  • Your Responsibility: You represent and warrant that you own or otherwise control all the rights to the images you upload. You guarantee that the image does not infringe upon the copyright, trademark, privacy, or other intellectual property rights of any third party.

  • Prohibited Content: You are strictly prohibited from uploading images containing copyrighted characters (e.g., Disney, Marvel), registered logos of other brands, or professional photography to which you do not hold the printing rights.

3. Right to Refuse Service & Indemnification We reserve the right, at our sole discretion, to refuse to process any order if we suspect that the submitted image violates third-party intellectual property rights. By using our service, you agree to indemnify and hold harmless MANH HUNG PRIVATE ENTERPRISE from any claims, damages, liabilities, and expenses arising out of any intellectual property infringement claim related to the image you submitted.

4. Global Copyright Infringement Reporting Beunikart operates globally and is committed to complying with international intellectual property laws. Depending on your jurisdiction, we handle infringement claims through formal "Notice and Takedown" or "Notice and Action" procedures:

  • USA Compliance (DMCA): For notifications under the Digital Millennium Copyright Act ("DMCA"), please ensure your notice complies with 17 U.S.C. §512(c)(3).

  • EU & UK Compliance: In accordance with the EU Digital Services Act (DSA) and the UK Copyright, Designs and Patents Act, we provide a strict "Notice and Action" mechanism. Upon receipt, we will review the dispute in accordance with the applicable intellectual property laws of your specific region.
